1. GENERAL TERMS AND CONDITIONS

1.1 These General Terms and Conditions shall expressly regulate the relationships that arise between Hispania Digital Technology, S.L., a company registered in the Companies Register of Alicante, in Volume 3474, Folio 6, Sheet A-122528, with CIF (tax ID code) B54513643 and registered address at Calle Grecia 11A Pol. Ind. Las Maromas - 03160 Almoradí (Alicante) (hereinafter “HIDITEC”) and third parties (hereinafter “Customers”) that register as Customers and/or acquire products through the online store of the HIDITEC websites (www.hiditec.com) (hereinafter the “Store”).

2. CUSTOMERS OBLIGATIONS

2.1 The Customer undertakes, in general, to use the Store, to acquire the Products and to use each of the Store’s services in a diligent manner, in accordance with the Law, morals, public order and the provisions of these General Terms and Conditions, and should likewise refrain from using them in any manner that may prevent, damage or impair normal operation or use of the Store by Customers or that may cause harm or damage to the property and rights of HIDITEC, its suppliers, Customers or, in general, any third party.

3. PRODUCTS AND PRICES

3.1 HIDITEC reserves the right to decide, at any time, the Products available to Customers through the Store. In particular, HIDITEC may at any time add new Products to those offered or available on the Store and with the understanding that unless otherwise stated, such new Products shall be governed by the provisions of these General Terms and Conditions. Likewise, HIDITEC reserves the right to stop providing or facilitating access to and use of any of the different kinds of Products offered on the Store at any time and without prior notice.

3.2 Product images on the Store will match the actual Products as closely as possible to the extent allowed by visualisation technologies on the Internet. The features and prices of the Products are shown on the Store. All prices on the Store are in euros and include 21% VAT, unless otherwise stated.

4. PRODUCT PAYMENT METHODS

4.1 Within a maximum of forty-eight (48) business hours, HIDITEC will send the Customer an e-mail confirming their purchase. This e-mail will list the features of the Product, its price and applicable shipping fees.

4.2 The Customer acquiring the product through the Store must pay for it using the payment methods specifically listed on the Store.

4.3 HIDITEC will file the electronic documents formalising the contract and will send the Customer a copy once the purchase has been completed.

4.4 The order confirmation sent by HIDITEC is not valid as an invoice; it is merely proof of purchase. HIDITEC will send the invoice and/or receipt corresponding to the Product together with it.

5. RETURN POLICY. CHANGE OF OPINION. RETURN COSTS

The right to withdraw is the customer’s right to cancel the purchase made under Articles 68 and 102 and following and related provisions of Royal Legislative Decree 1/2007, of 16 November, adopting the consolidated text of the General Law for the Protection of Consumers and Users and other complementary laws.

5.1 The customer has the right to withdraw from the contract within a period of 14 calendar days as of receipt of the order, without indicating the reason and without incurring any cost, except for those provided for under Articles 107.2 and 108 of Royal Legislative Decree 1/2007, of 16 November, adopting the consolidated text of the General Law for the Protection of Consumers and Users and other complementary laws, including return costs and costs of the delivery method chosen by the customer (“home delivery”) that exceed the cost of the ordinary delivery method.

5.2 The right to withdraw shall be exercised in accordance with the following terms and conditions:

Customers shall have 30 days to exercise the right to withdraw as of product delivery date by simply notifying HIDITEC of their decision through any of the channels established for this purpose.

The customer can process withdrawal through the Customer Portal https://www.hiditec.com or over the Customer Service telephone number +34 965 726 425, Monday–Friday from 9:00 a.m. to 6:00 p.m. Once requested, HIDITEC shall acknowledge receipt of the request and provide the customer with a return registration number in the email indicated in the purchase process. HIDITEC shall manage the collection of the product at the address where the delivery was made, unless the customer wishes to manage the return on his or her own account. In the event that the customer should indicate that the collection needs to be made at a different address, the customer shall be informed of the additional cost of return which, where appropriate, may be involved.

In both cases, HIDITEC shall provide the customer with a package label or identifier code that must be attached or indicated on the outside of the packaging along with the shipment details.

The customer must return the product unused in their original packaging. This means that the product must be complete, undamaged and must not be dirty. Moreover, it must be returned with the instructions and other accessories originally delivered with it.

Products must be returned in the original packaging. In case of damage, once the product has been received and inspected, the customer shall be informed of the cost of the depreciation involved which, where appropriate, shall be discounted from the total amount to be reimbursed.

5.3 Customers exercising their right to withdrawal shall have to pay the direct costs of returning the goods, which will be deducted from the amount to be reimbursed. The return cost fee for all products in Spain and Portugal is €6.00.

HIDITEC shall refund the customer the total amount paid, less the return fee, without undue delay and, in any case, no later than 30 calendar days after HIDITEC has been informed of the decision to withdraw. The refund shall be made via the same payment method used for the initial transaction, without prejudice to customer consumer rights.

5.4 The customer must bear in mind that, if the product to be withdrawn has been purchased as part of a pack of two products, thereby forming part of an offer involving each product, the customer shall not be required to return all the products that make up that pack. However, if returning only one of the products, only the difference between the amount paid for the purchase of the product pack and the normal, unreduced sale price of the unreturned product will be refunded. Accordingly, for customer information purposes, the pre-contractual information on the pack itself will indicate the individualised normal sale price of each of the products that comprise it (price per unit of measure).

5.5 The customer must bear in mind that there are some products which, by their very nature, have special return conditions: 

To exercise the right to withdraw regarding certain products from the “Audio and Accessories” range, such as Headphones, Earbuds, Backpacks and Caps, these must be returned unused in their original packaging for reasons of both health protection and hygiene under Article 103(e) of Royal Legislative Decree 1/2007, of November 16, adopting the consolidated text of the General Law for the Protection of Consumers and Users and other complementary laws.

6. CUSTOMER SERVICE 

6.1 Customers can use the forms at the shop to make claims or queries about incidents. 

7. HOME DELIVERY SERVICE

7.1 The territorial scope of sales through the Store is exclusively within the national territories of Spain and Portugal; therefore, the delivery service will only be available for these territories. Products bought through the Store will be sent to the delivery address specified by the Customer once payment has been confirmed. The maximum delivery time is thirty (30) days as established by Law. Average delivery times range between 3 and 4 days.

7.2 HIDITEC′s delivery service is provided in collaboration with renowned logistics companies. Orders will not be delivered to PO Boxes, hotels or other nonpermanent addresses.

7.3. Shipping costs are not included in the prices of the Products. Upon acquiring a Product, the Customer shall be informed of the exact shipping cost.

7.4 Customers in the Canary Islands, Ceuta, Melilla and other international destinations will be responsible for paying customs and/or import duties. Shipping fees do not include customs duties and/or VAT in the country of origin. HIDITEC shall not be liable for any other additional charges; the Customer shall be liable for these charges.

8. INTELLECTUAL AND INDUSTRIAL PROPERTY

8.1 The Customer acknowledges that all elements of the Store and each of the Products, the information and materials contained therein, the brands, the structure, selection, arrangement and presentation of content, and the computer programs used in relation to them, are protected by the intellectual and industrial property rights of HIDITEC itself or of third parties, and that the General Terms and Conditions do not grant any other right to the Customer with regard to these industrial and intellectual property rights other than those specifically provided for therein.

8.2 Unless authorised by HIDITEC or, as the case may be, by the third parties holding the corresponding rights, or unless this is legally permitted, the Customer may not reproduce, transform, modify, disassemble, reverse engineer, distribute, rent, lend, make available or allow access to the general public through any form of public communication any of the elements referred to in the previous paragraph. The Customer must use the materials, elements and information accessed through the use of the Store solely for their own needs, and undertakes not to make commercial use of the materials, elements and information obtained through them, whether directly or indirectly.

8.3 The Customer must refrain from circumventing or manipulating any technical devices put into place by HIDITEC or third parties on the Store.

9. DATA PROTECTION

9.1 All information provided through the registration form, as well as information arising from the transactions processed will be stored in a data file owned by HIDITEC as long as cancellation of it is not requested. Processing is aimed at completing the sale, providing personalised services for the products and services acquired, and until no notice of opposition is given, improving these services, as well as promoting HIDITEC’s own products and services, as well as those of third parties linked to it. In this way, the Customer consents to receiving commercial communications and promotional offers and contests, including through electronic means, from the above-mentioned companies.

9.2 The Customer may exercise their rights of access, correction, cancellation, and opposition by contacting HIDITEC at any time via en e-mail sent to info@hiditec.com.

10. CREDENTIALS

10.1 HIDITEC will provide personal credentials for the use of Customer registering as such on the Website if deemed necessary. Such credentials will enable access to the services provided by the Website. Customers must keep their credentials in strict and utmost confidence under their own responsibility, thereby assuming all damage and consequences of any kind that may arise from the breach of confidentiality or disclosure of information. For security reasons, the credentials for electronic access to the services linked to the Website may be modified by HIDITEC at any time. The Customer undertakes to notify HIDITEC immediately of any unauthorised use of their credentials, as well as any unauthorised access to them by third parties.

11. COOKIES

11.1 HIDITEC uses cookies for the purpose of improving its services, facilitating browsing, maintaining security, verifying the identity of the Customer, providing access to their personal preferences and tracking their use of the Store. Cookies are files installed on the computer′s hard drive or on the browser’s cache in the folder preconfigured by the operating system on the Customers computer to identify them. To process the information collected, we will occasionally use service providers that will help us compile statistics from this data. As such, this data may be transferred for the sole purpose of compiling these statistics with the appropriate guarantee.

11.2 If the Customer does not want cookies to be installed on their hard drive, they should configure their Internet browser to reject them. Additionally, the Customer may destroy the cookies on their own. Should the Customer decide to disable the cookies, the quality and speed of the service may diminish, and they may lose access to some of the services available on the Store.
